Terms and Conditions
- ‘Looksee Design or Looksee’ is Retta Laraway trading as Looksee Design ABN 77 108 701 884
- ‘The Client’ is the party making a booking for design related services from Looksee Design
- ‘An Order’ is the request for services from Looksee Design
- ‘The project’ is a term used to describe the service from Looksee Design
The terms and conditions apply to all dealings between The Client and Looksee Design. By placing an order with Looksee Design, you as a Client are forming a legally binding contract for services and you agree to the following terms & conditions.
All quotations are valid for 14 days. Any quote not accepted within this time is subject to a re-quote. All prices are quoted in Australian Dollars. Any additional work not quoted, or outside the original scope relating to the project will be charged at an hourly rate of $90 p/hr.
Looksee Design is not responsible for increases in materials by third party services if Looksee Design is organising this for you (e.g. printers, sign writers, copywriters, photographers) where the increases are beyond our control. Looksee Design reserves the right to change pricing without notice.
Proposals are valid for 14 days from the date shown on each document. The proposal include costs for design concepts/visuals
and two set of author’s correction. Any changes thereafter may result in a change in cost, of which you will be advised as soon as
Prior to commencing the project we will establish a project schedule and time line that is suitable to us both. In the event that you do not keep this schedule and the duration of the job exceeds three months from commencement, Looksee Design reserves the right to finalise the project as if it were completed and invoice accordingly.
The Client agrees to make available as soon as is reasonably possible to Looksee Design all materials required to complete the project to the agreed standard and within the set deadline. Looksee Design will not be held liable for a Client’s or third-party’s failure to provide materials requested by Looksee Design if it results in a missed deadline.
Payment is required prior to releasing final digital files and/or supplying files for printing and websites. Payment must be made within 7 days of the date of the invoice. Fees do not include additional media purchases (domain names, hosting, stock images, commercial fonts, software etc.), unless otherwise stated.
All work is presented to you in draft format. Once payment is received you will receive final files. Payment can be made via direct deposit. International Clients can make payment via Pay-pal. International Clients are required to make payment in full, prior to commencement of projects. If debt collection is required for unpaid invoices, The Client is responsible for any costs incurred (fees / commissions payable to the debt collectors).
A payment of 50% of the quoted price will be required upon commencement of the project. (This is non-refundable should you abandon the project for whatever reason) with remainder of the total quoted price (50%) upon completion of the project is required. Final files will not be release until this payment is made.
Although great measures are taken to produce the work properly, Looksee Design will not be held responsible for errors in rush projects and will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
Additional ad-hoc professional services can be provided as required, such as logo design and branding, brochure design and other forms of marketing material, for a full list of our services please visit our website or contact us to discuss your requirements.
The Client assumes full copyright and reproduction rights upon full payment of a completed project. Looksee Design retains personal rights to use completed projects and concept artwork for the purpose of marketing Looksee Design. All images displayed on the Looksee Design website or facebook page are subject to copyright, and must not be copied or used without full permission from Looksee and the Client. Any breach of copyright will result in action being taken as necessary.
The Client allows Looksee Design to display any projects on the Looksee Design website / social media page / and online portfolios for self promotion purposes. The Client agrees to allow Looksee Design to credit design work on all websites designed by Looksee Design.
Ownership and Usage Rights
Upon receipt of full payment, the client is hereby granted exclusive and unlimited usage and reproduction rights to the final designs prepared for the client as part of this project. Looksee Design reserves the right to reproduce any and all designs created in print and electronic media for Looksee Design ’s promotional purposes.
Looksee Design will make every effort to meet deadlines. All quoted turnaround times are approximate. Looksee Design will not be held responsible or liable for any costs resulting from late artwork or printing deliveries. Errors The client has the responsibility to proofread and review all work produced during the project. As a result, the client The client is fully responsible for any errors in spelling, typography, illustrative layout, photography or other errors discovered after printing, reproduction or going live and any work performed by third-parties selected by the client The client..
The Client is allowed two sets of revisions to their project. Any authors corrections or amendments outside of the quotation or nominated 2 sets of revisions, are charged at an hourly rate of $90 p/hr. Looksee Design makes every effort to deliver concepts to suit the Client’s brief. If the Client is not happy with the concepts provided by Looksee Design, and the amends do not fall within minor ‘revisions’ to the project, the Client can pay for further concepts to be developed or choose to not proceed, and pay for ‘work to date’.
Approval is required for all projects prior to work being released,this can either be done via downloading our approval form or returning the copy emailed with the final proof. Whilst all care is taken by Looksee Design, Looksee Design is not responsible for any spelling, grammatical, numerical errors or omissions after final approval. Even if these errors are from Looksee, it is the Client’s responsibility to proof read and check thoroughly their projects to identify any errors prior to approval. The Client is fully responsible for reprint and productions costs should they decide to print again. No refunds will be issued by Looksee Design.
Cancellations and Incomplete Projects
In the event The client cancels this agreement prior to completion, within five (5) business days of such cancellation, The client shall pay Looksee Design for: (1) all work performed up to the date of termination; (2) all outside expenses and commitments that have been incurred and cannot be cancelled; and, (3) a cancellation fee equal to 30% of the remaining fees that would otherwise have been paid if the project would have been completed.
Supply of Files
Looksee Design supplies files to printers as high resolution PDF files.
Looksee Design supplies logo files to the Client in print and web formats, (EPS. PNG & JPG)
Other than logo supply, Looksee Design does not supply working files (ie Adobe Indesign , Photoshop or Illustrator files)
High Resolution PDFs of artwork can be supplied at the Clients request at the time of project completion. Supply of any files after project completion, will incur a fee, to cover times spent to retrieve files from archives. Due to Licensing of software, any additional file format supply will also incur a fee charged at an hourly rate of $90 p/hr.
Looksee Design will not supply any commercially licensed fonts to the client, these have a single licence usage and cannot be shared or provided to another party as per the terms and conditions of the font foundries. If the client wishes to use these fonts they must be purchased from the relevant font foundery in their own name.
Images and Commercial Fonts
Some designs may contain stock photography that is available for purchase. Any items designed by Looksee Design that are offered for sale, will require license rights to be purchased for any stock images.
Any images supplied by the Client must be provided in high resolution. Looksee Design is not responsible for colour variations in conversion from RGB to process CMYK
Looksee Design is not responsible for the reproduction quality of supplied images, if images are supplied as low res files.
Looksee Design is not responsible for the reproduction quality of supplied images in word or publisher.
Looksee Design cannot be held responsible for the quality of any images or copyright infringements which the client wishes to be scanned from printed materials.
Text is preferably be supplied to Looksee Design in electronic format as standard text (.txt), MS Word (.doc)
Looksee Design will not use any imagery taken from google search and will not be held liable for any images that taken from google search and provided to Looksee Design for inclusion in any project without Looksee Designs knowledge.
Any costs for Commercially licensed fonts that are required to be purchased will be passed on to the client.
Colour Matching and Printing
Whilst all care is taken, Looksee Design does not take responsibility for Client supplied artwork that does not print properly. Looksee is not liable for any printing errors, using the Clients chosen printer, unsupervised by Looksee Design.
Looksee Design work with a number of printers and are happy to recommend their services.
Please note that colour on projects can vary from screen to final product. Screen proofing is not indicative of final printed piece. Printed colours can vary from printer to printer, job to job, run to run, or even front to back, due to the nature of the CMYK printing process. If it is imperative that the clours are exact due to style guides we suggest you seek a printers proof.
Trimming can vary from printer to printer. Text should not be placed within 3mm from any edge preferably 5mm.
If Looksee Design is arranging printing for a client, the cost of the printing must be paid in full by the client prior to the job going to print.
Social Media Images
Looksee Design has no control and accepts no responsibility for changes to Facebook or other Social Media platforms procedures, nor responsible for changes that may occur to work we have created due to third party changes. A fee will be applied at a rate of $90.00 an hour to fix and rectify image dimensions for images or profile images etc.
In the event that Looksee Design has outsourced a service on a clients behalf such as copywriting, SEO, Photography or Printing, Looksee Design will not be held accountable for increases in charges or timeframes not being met.
Website Design And Development
Where Looksee Design have quoted a website these quotes include the cost of design work and development work, either to be uploaded to your existing server or to use our preferred content management systems (Adobe Business Catalyst or WordPress) all quotes are custom to your requirements. Changes and Alterations to existing pages will be charged at an hourly rate of $90 p/hr. Design only is when we supply of layered PSD file for your preferred developer top complete.
Looksee Design will not be responsible for work created by a third party developer. If you prefer we can create custom designed template (normally home and one inner page included) and provide a html/css template you to complete yourself. Once web design is complete, Looksee Design will provide the customer with the opportunity to review the resulting work. Looksee Design will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. It does not include changes to images, colour schemes or any navigation features. Any minor changes can be notified to Looksee Design by e-mail. Looksee Design will consider that the client has accepted the original draft, if no notification of changes is received in writing from the customer, within 14 days of the start of the review period.
Hosting And Domain Names
Looksee Design offer in-house hosting services via Adobe Business Catalyst. Looksee Design can also suggest other possible host however does not guarantee continuous service and will accept no liability for loss of service, whatever the cause. Looksee Design may request that clients change the type of hosting account used if that account is deemed by Looksee Design to be unacceptable because of poor service, lack of bandwidth or in any other way insufficient to support the website. Fees due to the hosting organisation are the responsibility of the client and Looksee Design is not liable for their payment. Looksee Design cannot guarantee the availability of any domain name.
Where Looksee Design is to register a domain name on behalf of a client it will endeavour to do so but the client should not assume a successful registration. Fees due to the domain organisation are the responsibility of the client and Looksee Design is not liable for their payment.
